Agreement to Terms

By accessing or using the OneSpot Services platform, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.

These terms constitute a legally binding agreement between you and OneSpot Services Ltd regarding your use of our platform and services.

Definitions

"Platform" refers to the OneSpot Services website, mobile applications, and related services.

"User"/"Client" refers to any individual or entity accessing or using the Platform, including customers seeking services.

"Service Provider" refers to verified professionals offering services through our Platform.

"We"/"Us"/"Our" refers to OneSpot Services Ltd, a company registered in Kenya.

"Content" includes text, images, photos, videos, and all other materials on the Platform.

Eligibility

To use our Platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information
  • Not be located in a jurisdiction where our services are prohibited
  • Not have been previously suspended or removed from our Platform

User Accounts

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms.

Our Services

OneSpot Services provides a platform that connects users with verified local service providers. Our services include:

  • Quote request and matching services
  • Provider verification and background checks
  • Customer review and rating system
  • Communication facilitation between users and providers

Important: We are a platform, not a service provider. We do not perform services ourselves and are not responsible for the quality of work performed by providers.

Service Providers

Service providers on our platform are independent contractors, not employees of OneSpot Services. We:

  • Verify credentials and perform background checks
  • Do not control the manner or method of work
  • Are not responsible for work quality or completion
  • Provide reviews and ratings for transparency

Quote Requests

When submitting a quote request:

  • You agree to provide accurate information about your needs
  • You consent to being contacted by verified providers
  • Quotes provided are estimates and may vary based on inspection
  • We do not guarantee that you will receive quotes
  • We do not endorse any specific provider or quote

Payments & Fees

For Customers:

  • Quote requests are completely free – no charges for browsing or requesting quotes
  • Payment for services is made directly to the provider upon agreement
  • We do not handle payments between users and providers
  • Any fees charged by providers are between you and the provider

For Service Providers:

  • Commission is deducted immediately when a client hires you through the OneSpot platform
  • The commission fee is a percentage of the total job value as specified in your provider agreement
  • All fees are transparent and communicated in advance before you accept any job

Commission Refund Policy

In the event of a disagreement or dispute between the provider and the customer that results in the job not being completed or the customer being unsatisfied, OneSpot Services offers a fair refund process.

Commission refunds are processed through our Operations Officer upon verification of the dispute. If a job is not successfully completed or is deemed unsatisfactory, the commission fee will be refunded to the provider.

Our commitment: We believe in fair transactions. Commission is only earned when the job is successfully completed. If things don't work out, we've got your back with our refund process.

Cancellations & Refunds

Cancellation and refund policies are determined by individual service providers. We recommend:

  • Discussing cancellation terms before hiring
  • Getting agreements in writing
  • Contacting us if disputes arise
  • Note that we do not process refunds directly

Limitation of Liability

To the maximum extent permitted by law, OneSpot Services shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Services provided by third-party providers
  • Any disputes between users and providers
  • Technical issues, interruptions, or errors

Our total liability shall not exceed the amount you paid us, if any, in the past 12 months.

Privacy Policy

Your use of our platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

User Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Post false, misleading, or fraudulent information
  • Harass, abuse, or harm others
  • Interfere with platform operations
  • Attempt to gain unauthorized access
  • Use the platform for illegal purposes
  • Share inappropriate or offensive content

Intellectual Property

All content on our platform, including logos, text, graphics, and software, is the property of OneSpot Services or its licensors and is protected by Kenyan and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works without our express written consent.

Termination

We may terminate or suspend your access to our platform immediately, without prior notice, for any reason, including violation of these Terms.

Upon termination, your right to use the platform will cease immediately.

Dispute Resolution

Any disputes arising from these Terms or your use of the platform shall first be attempted to be resolved through informal negotiation.

If negotiation fails, disputes shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Sending email notifications for material changes

Your continued use of the platform after changes constitutes acceptance of the new Terms.
